Most residents don't know that EAST MESA PUBLIC LAND IS NOT BLM, NOT CITY, it is administered by rules of STATE LAND OFFICE.
A group of residents wants to lease it, and get hidden cameras installed, signs put up (no dumping, and Ns shooting, and no entrance at all without permit. Currently everyone there is trespassing. I bought a yearly permit just to walk there, for $35.

The above ONX map shows why there is so much confusion over who owns what and can or can not hunt and shoot when and where. BLM (in darker green) has one set of regulations, State Land Office parcel (in green box Aldrich & Dunn Drive) has their regulations, the County lands (in light green), where Boje lives is in Dona Ana County, while across the street north me it is City of Las Cruces which has a no gun ordinance covering no shooting (not even a BB gun) at anytime for any reason on the entire map area.

Above in the last sentence, is the sticky point. To fire your guns on STATE LAND OFFICE ' (SLO) State Trust Lands', do hunters and target shooters need SLO permission? Time to call 505-827-5760 and find out the truth.

"You can only enter state trust land for hunting during the season for which the license applies plus a seven-day scouting period prior to that season. There is no license for unprotected species, so they are not covered by the current easement with the Department of Game and Fish. You cannot enter state trust land only to hunt unprotected species.

"A valid hunting, fishing, or trapping license allows for access onto state trust land through the State Land Office’s easement agreement with the New Mexico Department of Game and Fish. Access is only allowed during the ongoing hunt for that specific area, and it also allows for scouting access up to 7 days prior to the hunt."

This parcel of Public Land (above in map) according to Dona Ana County Assessor's Office (Las Cruces), is actually owned by the 'State Land Office' which is administered by District Resource Manager Michael Quintana, MQuintana@slo.state.nm.us , (mobile) 575-644-0673.
It is not owned by Bureau of Land Management (BLM), its Federal Land, Department of the Interior. It is on a county road named "Gas Line Road' that runs diagonally from lower left to upper right. The street on right id Dunn Drive, the street on very top is Aldrich (between Porter and Dunn).

In above State Land Office map, the dotted red lines are
dirt roads that lead to the pond. With several access routes
and no signs on any of them, illegal dumping and toxic
polluting is going on.
I have been picking up beer bottles and can, liquor
bottles, and hauling out the burn pits ash and embedded

The technical terms (Before, Beneath, Bets, Becoming, Between and Beyond) are from my work on the science of storytelling.
BENEATH - To tell this story, you need concepts (foreconceptions) and here I show the relation between concepts of Physical World, Mental Word (what story is in head of people dumping and burning, polluting and breaking laws) and the Mental World of the government, the residents looking as bystanders doing nothing.
BETS ON THE FUTURE - What future do all the characters (government & business, K-12 & Universities, & environment organizations, and residents of New Mexico want. The leases raises money for schools, However, currently the parcel is not leased for anything.
BECOMING - I haul out the burn pit each time it reappears, and haul out the daily litter. Good news, for last five days June 19 to June 23 2020, no more litter or burn pits. It's peaceful place with potential.
BETWEEN - The jurisdictions for governing the uses and care of the land fall in-between the infrastructure of City, County, and Federal - State Land Office. Most residents and many officials assume it is BLM that has jurisdiction. Not True at all.
BEYOND - means intuitive that is beyond the five senses, and here I am working with Shamanic Drumming Circle folks who came up with this idea to storyboard the situation in our Meeting Jun 22 2020. I also listen to the place, its flora and fauna, its water, to get some sense of that story. It was suggested by a storytelling colleague to place a spiritual symbol (such as Virgin Mary) next to the burn pile, as an experiment. I chose some stones, and made the shape of the cross. I did this on June 18, 2020 and removed the burn pit you see above.
POTENTIALITY-for-Being-A-Whole Ephemeral Wetlands Pond In Arid Desert of New Mexico. My discussions with stakeholders suggest making it part of citizen science, a place where families K-12, and University folks can go as 'citizen scientists' to learn about water, about impact of climate change, invasive species of plants & trees, geology, biology, hydrology, the food chain of the pond, and how to care for an ecosystem.
This is the current Mission of State Land Office:
"This land, referred to as state trust land, was allocated to New Mexico by the Federal Government under the Ferguson Act of 1898 and the Enabling Act of 1910. The mission of the agency is to use state trust land to raise revenue for New Mexico public schools, hospitals, colleges, and other public institutions. The entities are the beneficiaries of revenue raised when the Land Office does business on state trust land. Ephemeral Pond in early June 2020, as the dump site for trash, buring tires (I rescued these, and take out the trash daily), buring pallets, burning discarded couches and easy chairs, old big screen TVs, burning mattresses, and buring plastic water bottles, soda bottles, shot gun sheels, riffle casings, small arms shells, and glass beer and wine and liquor bottles. It is wreckage upon wreckage in the history of the pond, and the pond's ecosystem is collapsing. Without care of many residents and many city, county, state, and federal agencies, it will be gone.

Nature provides us with a Water Cycle to Cleanse and
Purify Fresh Water in our Glaciers, Rivers, Oceans, Lakes,
and Rain.
Do We Want New Mexico's Wildlife Ponds to
Look Like this Ocean Beach?
When we
humans pollute Our Desert Ephemeral Ponds (during 9 or
19 dry months) with burning tires and tossing plastic
water bottles and Styrofoam into a desert pond, that
irresponsible behavior affects the Water Cycle for us
All, especially Migrating Birds and Wildlife when the
rains come those few days and the pond is life-giving.
Why is this a huge problem? Because all the water that ever was in the world is the only water we will ever have. Earth's water cycle is a closed system, and this seeps into our groundwater, and evaporates into our atmosphere, then those nanoparticles of plastic pollution move around the entire world.
This is
about true storytelling, moving out of untruth of
bottled water, beer, and other advertising narratives of
living now and acting irresponsibly so to the planet as
to not notice the life cycles of Ephemeral Ponds and the
Seasonal Water Cycle that life depends upon. And its
SOLUTIONS to Living in the critical zone as Latour calls
it, and caring for Ephemeral Ponds of near- or
endangered- or -any species in search of freshwater to
sustain their life cycle. This is a series of videos
that can be used in K-12 and university settings.

In Part I, I David Boje, a storytelling researcher with 25 books and 150 articles on storytelling in society, was shocked to find tires being burned in the desert of Las Cruces on of the East Mesa. He tells the history of his father's trash compactor invention. Boje found trash in the desert of New Mexico HAS A STORY IT TELLS. How do we listen to it? I hear an onto-story of our existence on this planet. An ONTO-STORY is about the 'vibrant matter' of things, how the energy of an ASSEMBLAGE of things has a story to tell. Onto-story comes from the awesome work of Jane Bennett (2008, Vibrant Matter book). William James the pragmatist, says things tell a story. Here I find tires in the desert that are not yet burned, on a pile of already burned tires, beer cans and bottles, plastic of all types of bottled water, and other litter. It's a tragedy of the commons, the CRITICAL ZONE of living Earth, that nobody seems to care about, until the ground water is polluted by nano particles of plastic from what is being burned. Sure its illegal, but what kind of education and parenting system raises its youth to not care. In Part II, I pack out the tires, glass bottles, plastic battles, and so on. Henry Thoreau went out to find the TRUTH about
Life, True Storyteller Research David Boje is trying to save
the Ephemeral Pond has important hidden species can survive in
that place. After contacting the Mayor of Las Cruces, his
Council person for East Mesa, The BLM manager, the County
Manger, the County Commissioner, The police Chief and Codes
Enforcement, on May 29 2020, the government consensus was
cannot do anything during the Corona Pandemic to help the East
Mesa Ephemeral Pond. So David Boje, a citizen scientist and
Regents Professor Emeritus of New Mexico State University
loads up burned shopping cart, burned plastic, and heaps of
beer cans and bottles to get the pond ready for June July rain
when it will fill up and the life cycle of a near-threat level
endangered species the symbol of New Mexico, the Spadefoot
Toad, and an actual endangered species, the NM Fairy Shrimp,
will have the water to come out of the soil, grow to adult,
find a mate and reproduce. They provide food for many other
bird and animal species. Some 47 aquatic species can thrive in
Ephemeral Ponds of New Mexico, or Party Animals can gather and
trash the 'Place'

David Boje, storytelling
researcher found the ephemeral pond trashed in the East Mesa
desert of New Mexico. He heard from the police and various
government officials, that during covid19 pandemic, resources
too lean to respond, so Boje is cleaning up the mess of the
ongoing youth partying, himself. TRASH HAS AN ONTO-STORY IT
TELLS. Onto-story comes from work of Jane Bennett, about
vibrant matter of things, and the story of their existence and
our own, being told. How do we listen to onto-story? Boje
takes a forensic approach, by asking trash burned what is your
history, what story do you have? Then he looks a the true
storytelling of Henry David Thoreau, and in next segment the
critical zone of planet Earth (Latour) and Butler’s staying
with the trouble, our accountability and our answerability to
act (as Bakhtin calls it). What is our responsibility to the
soon to be endangered spade foot toad and currently endangered
species, the Ne Mexico fairy shrimp?

Boje the storytelling researcher, listens to the onto-story
the trash bags are telling him. He posits scenarios about the
socioeconomics situation of families resorting to tasing their
trash bags of garbage into an ephemeral pond in the desert.
Its like the party goers are bringing the family trash to the
event. But are the middle class litters or so poor they cannot
afford Dona Ana County landfill fees? Things tell as story
says William James, and this trash speaks volumes.

David Boje, offers solutions to the 15 year
problem of Party Animals trashing the desert, folks dumping
their trash bags in the Ephemeral Pond of East Mesa, New
Mexico. As a storytelling researcher, Boje is intervening by
RESTORYING the problem as systemic, as intergovernmental, as
K-12 and university education, and as the continuing quest to
move from UNTRUTH into Living story relationship to Nature, to
Gaia. This means staying with the trouble (Haraway) and being
answerable for one's own acts and deeds in the world. It is a
recognition of the CRITICAL ZONE of a thin crust like an egg
shell of soil and atmosphere and water around the earth, and
we have to be able to help it not breakdown.
WHAT IS THE NEXT FILM? In June and
July I will film the Life cycles of the Ephemeral Pond,
showing the New Mexico Spadefoot Toad uncovering itself from
its Hiddenness in the soil for 10 months, once the pond fills
with rain water in June and July, then as the pond evaporates
with no more rain in August, new generations burrow into the
ground to hyphenate for 10 months until the life cycle
repeats. Similarly, the New Mexico Fairy Shrimp's in their
little pods, hatch once the June and July rainfall fills he
Ephemeral Pond, feasting on the algae, mating, reproducing,
until August or whenever the pond dries up. These two
primordial living cycles interact with the seasonal
Hydrological Cycle of evaporation, cloud transportation of
water vapor, and precipitation.

Boje is drumming a prayer with his two Power Animals, the Spadefoot Toad and the Fairy-Shrimp. Boje stands on the chain of events, seeing one single catastrophe which keeps willing wreckage upon wreckage and hurls it in front of his feet. The Angel of History would like to stay to help the EAST MESA EPHEMERAL WETLANDS POND of Las Cruces New Mexico, awaken the dormant spadefoot and fairy, before they have been smashed.. But as Benjamin notes a storm is blowing form the progress myth of Late Modern Capitalism. The Angel's wings are caught in such violence, a story sweeping across the USA, it is propelled into the future to which its back was turned, while the pile of debris before him grows skyward. This story is what we in the USA call progress. This is 8th video record of perhaps the last living season of Ephemeral Pond, that gives up its last breath after two centuries of history to the conformism of wage slaves doing their role to Party On in the midst of Fascism. A little shamanic drumming brings joy and some peace to the usual wreckage of the biodiversity of the pond. Thank you to dedicated people coming to help
